1. Introduction & Agreement to Terms
Welcome to MyFamilyStory.com. This site is operated by Cloudhands, Inc., doing business as MyFamilyStory.com (“MyFamilyStory,” “we,” “us,” “our”). These Terms of Service (“Terms”) govern your access to and use of our website at MyFamilyStory.com, along with any related services, features, or content available through our platform (collectively, the “Platform”).
MyFamilyStory is designed to help you explore, preserve, and celebrate your family heritage. We offer a variety of tools, features, and creative experiences so you can bring your family history to life. Some features are available at no cost, and others are unlocked through one of our subscription plans. Our goal is to make pricing clear, predictable, and easy to understand so you always know what your creations cost.
By using the Platform, you may:
- Upload and enhance family photos — including restoring or reviving old images of loved ones.
- Import your family tree data — if you have an account with another genealogy or heritage service, you can upload your GED file to make building your story faster and easier.
- Create your Family Atlas and Tree — map relationships, trace history, and see how your family’s story connects across generations.
- Generate stories, recipes, and memories — using your available credits and subscription tier.
- Invite family members — depending on your plan, you can collaborate with relatives to build a shared family archive.
We encourage you to explore the Platform and discover your ancestors in a whole new way.
By accessing or using our Platform, you agree to these Terms. If you do not agree, please do not use the Platform. Your use of the Platform is also subject to our Privacy Policy, Acceptable Use Policy (AUP), and Credits Policy. In the event of any conflict between these Terms and any other agreement between you and MyFamilyStory, these Terms control.
We strive to keep these Terms clear because honoring your family’s heritage should feel welcoming, not confusing. MyFamilyStory was built for people who care deeply about the lives that came before them. Our role is to handle the complex parts behind the scenes so you can focus on preserving, celebrating, and sharing the stories of your ancestors with dignity, accuracy, and respect. Every feature on our Platform is designed to help you create meaningful experiences that reflect the reverence you hold for your heritage and the individuals whose memories you are safeguarding.
2. Eligibility & Account Registration
2.1 Eligibility
The Platform is available only to adults. You must be 18 years of age or older to create an account, purchase a subscription, or use any credit-consuming features. By accessing or using the Platform, you represent and warrant that you meet this requirement.
MyFamilyStory is built for individuals who take seriously the responsibility of honoring their family’s heritage. Because our features involve the recreation of likenesses, voices, and personal histories, we require adult judgment and accountability during our initial launch phase. Youth and teen access will be introduced in a later release, once our dedicated safeguards and COPPA-compliant environments are complete.
2.2 Account Registration
To use the Platform, you must create an account and provide accurate, current information. You agree to keep your information updated so that we may maintain the integrity and security of your family’s archive.
You are responsible for safeguarding your login credentials and for all activity that occurs under your account. Because the Platform enables the creation and preservation of sensitive family materials, including revived likenesses, synthetic voices, and historical narratives, you agree to take reasonable steps to protect your account from unauthorized access.
Each user receives their own account, even when participating within a shared Family Plan or Family Branch. This structure ensures clarity of permissions, accountability, and respect for the stories entrusted to our Platform.
3. User Roles
MyFamilyStory supports several adult user roles to enable thoughtful, lineage-based collaboration. Each role reflects a different level of participation within your family’s storytelling environment. Because our Platform involves the recreation of likenesses, voices, and personal histories, each role is designed to preserve clarity, accountability, and respect for the individuals whose stories are being honored.
Every user receives their own account. This ensures that contributions, permissions, and visibility settings remain tied to a specific adult, maintaining the integrity of your family’s shared archive.
3.1 Visitor
A Visitor is a non-subscriber who explores publicly available or free features of the Platform. Visitors may browse introductory tools, view sample stories, and learn about the Platform’s capabilities. Visitors cannot contribute content, join Family Branches, or access subscriber-only features.
3.2 Trial User
A Trial User is an adult who has purchased a trial period. Trial Users may explore a limited set of subscriber features, including certain AI recipes and collaboration tools. Trial access is temporary and subject to the terms of the specific promotion under which the trial was offered.
3.3 Subscriber
A Subscriber is an adult account holder with full privileges under their chosen subscription tier. Subscribers may:
- Create and manage Family Branches
- Upload photos, videos, audio, and biographical information
- Generate restored images, revived likenesses, synthetic voices, and narrated video stories
- Invite relatives into Family Plans or Family Branches
- Manage visibility settings and collaboration permissions
Subscribers carry the primary responsibility for ensuring that all content they upload is respectful, lawful, and submitted with the appropriate rights and permissions.
3.4 Family Member
A Family Member is an adult added under a Subscriber’s Family Plan. Family Members receive their own account and may participate in the Subscriber’s Family Branches according to the permissions granted by the Branch Owner. Family Members may contribute content only where allowed and may view shared materials that honor their family’s heritage.
3.5 Branch Member
A Branch Member is an adult Subscriber invited into a Family Branch created by another Subscriber. Branch Members may contribute content, collaborate on lineage-based storytelling, and invite additional relatives subject to Owner approval. Branch Members are expected to uphold the same standards of respect, accuracy, and care for ancestral materials as the Branch Owner.
3.6 Visiting Relative
A Visiting Relative is an adult, non-Subscriber invited by a Subscriber to view selected content within a Family Branch. Visiting Relatives begin with view-only access, allowing extended family members to experience and appreciate the stories being preserved without requiring a subscription. Visiting Relatives cannot upload content, modify materials, or invite others. However, a Visiting Relative may be granted limited creative ability through the following pathways:
- Subscriber-Gifted Credits — A Subscriber may choose to gift credits to a Visiting Relative, enabling them to generate a small amount of content or interact with certain shared materials using AI recipes.
- Top Up Packs — Visiting Relatives are permitted to purchase a restricted number of Top Up credit packs. These packs allow them to create content or use specific recipe-based features, but do not convert the Visiting Relative into a Subscriber and do not grant Family Plan privileges.
4. Family Branches & Collaboration
Family Branches are the heart of the MyFamilyStory experience. They allow adults who care deeply about their heritage to collaborate in a structured, lineage-based environment that honors the lives, stories, and memories of their ancestors. Each Branch is built intentionally, with respect for the individuals whose likenesses, voices, and histories are being preserved.
Family Branches are designed to reflect the way families actually exist, through biological lineage, shared ancestry, and the relationships that connect generations. They provide a safe, organized space where relatives can contribute thoughtfully, review materials responsibly, and ensure that the stories entrusted to the Platform are treated with dignity.
Community functionality may be limited or unavailable at launch. We may release community features gradually, and early versions may not include all planned capabilities. As we improve the Platform, we may add, modify, or discontinue community features. When required by law, we will provide notice of material changes that affect your paid subscription.
4.1 Family Branch Structure
A Family Branch is a shared storytelling environment created by a Subscriber. Branches may be organized around:
- paternal or maternal lineage
- ancestor-based pathways
- descendant-based pathways
- specific family lines or heritage clusters
Subscribers may create as many Family Branches as they wish. Each Branch is its own collaborative space, with its own membership, visibility settings, and content library.
4.2 Branch Ownership & Invitations
The Subscriber who creates a Family Branch is the Branch Owner. Owners hold administrative authority and carry the responsibility of ensuring that all contributions remain respectful, lawful, and aligned with the purpose of honoring family heritage.
Branch Owners may:
- invite adult Subscribers as Branch Members
- invite adult non-Subscribers as Visiting Relatives
- approve or decline invitations initiated by Branch Members
- manage visibility settings for the Branch
- moderate contributions and resolve disputes
Branch Owners are expected to exercise care when inviting relatives, especially when the Branch contains sensitive ancestral materials.
4.3 Collaboration Rules
Collaboration inside a Family Branch is designed to honor family heritage while maintaining clarity and respect for the individuals represented.
- Branch Owners and Branch Members may contribute content to the Family Branch.
- Visiting Relatives have view-only access unless gifted credits or permitted to use limited Top Up Packs.
- Visibility Filters may be applied by Branch Owners for the entire Family Branch and by Branch Members for their own view.
- All contributions must be lawful, respectful, and submitted with appropriate rights and permissions.
- Content involving likenesses, voices, or personal histories must be handled with care and reviewed thoughtfully before sharing.
Collaboration within a Family Branch is a privilege. Users who violate these standards may be removed from the Branch or have their access restricted.
4.4 Succession
If a Branch Owner terminates their account or becomes unable to moderate a Branch, Ownership may be transferred to another Branch Member designated by the Branch Owner. Succession ensures continuity of stewardship so that the Family Branch, and the ancestral stories it contains, remains protected and responsibly managed.
5. Subscription Plans, Pricing, Billing & Auto-Renewal
MyFamilyStory offers subscription plans for adults who wish to preserve and honor their family’s heritage. Each plan provides access to different levels of features, collaboration privileges, and credit entitlements. Subscription pricing, renewal terms, and cancellation rights are governed by this Section, while all credit-related rules are governed by the Credits Policy, which is incorporated by reference.
5.1 Subscription Plans
MyFamilyStory offers three subscription tiers. These tiers define the structure of your Family Plan and the number of adults who may participate under your subscription:
- Family Starter — Single-user plan for individual heritage preservation.
- Family Plan Members: 1 user (Subscriber only)
- Family Builder — Household-level plan supporting collaborative storytelling among close family members.
- Family Plan Members: up to 4 users (Subscriber + 3)
- Family Legacy — Extended family plan designed for multi-generational collaboration.
- Family Plan Members: up to 8 users (Subscriber + 7)
Family Plan membership may be limited or unavailable at launch and may be part of a future update to the Platform.
All subscription pricing, including monthly and annual rates, is displayed clearly during checkout and may change from time to time. Any price changes will apply at the start of your next billing cycle unless you are enrolled in a promotional program that guarantees your price (such as the Founding Member PriceLock Guarantee described in Section 6).
All credit-related entitlements associated with each tier, including credits, recipe allocations, rollover rules, expiration windows, consumption rules, discounts, grace periods, and history storage, are governed exclusively by the Credits Policy.
5.2 Allowance Estimates and Usage Variability
We want you to have a clear sense of how far your subscription can take you. Throughout the Platform, you’ll see helpful examples showing what your monthly credits might create — like how many recipes you could generate or how much Family Conversion talk-time you might enjoy. These examples are meant to give you a feel for what’s possible, not to promise a specific number of creations. Your actual results depend on how you choose to use your credits. Some features use more credits, some use fewer, and every family’s mix of stories, recipes, photos, and conversations is different. Think of these estimates as friendly guides to help you plan your journey, not fixed guarantees. You’re always in control of your credit usage, and you can check your balance anytime as you explore, create, and build your family story.
5.3 Auto-Renewal
All subscriptions automatically renew at the end of each billing cycle unless canceled. By subscribing, you authorize MyFamilyStory to charge your payment method at each renewal period for the applicable subscription price. MyFamilyStory will present renewal terms clearly at the time of purchase, send renewal reminders for annual plans and promotional periods that convert to paid subscriptions, and provide a simple cancellation mechanism within your account settings. Auto-renewal ensures uninterrupted access to your family’s materials and the tools used to preserve them.
5.4 Pricing Changes
MyFamilyStory may adjust subscription pricing from time to time. Any price changes will be communicated in advance and will apply at the start of your next billing cycle unless you are enrolled in a promotional program that guarantees your price.
If you do not wish to continue at the new price, you may cancel before the renewal date.
5.5 Cancellation
You may cancel your subscription at any time through your account settings. Cancellation:
- stops future charges
- does not refund past charges
- may result in the expiration of unused credits (see Credits Policy)
- may reduce or remove access to certain features
- may affect Family Branch participation and visibility settings
Your subscription remains active until the end of the current billing cycle.
5.6 Reactivation
If you reactivate your subscription after cancellation or lapse:
- your subscription will be billed at the current public price
- promotional pricing or guarantees tied to your prior subscription (including Founding Member status) will not carry over
- previously expired credits will not be restored
- access to certain materials may remain limited or require re-processing
Reactivation restores access to subscriber features but does not reinstate discontinued promotions.
5.7 Account Holds, Pauses & Interruptions
MyFamilyStory may offer account pause or hold options in the future. If available, these features will be governed by their own terms and may affect promotional guarantees, credit expiration, or access to certain features. Pausing or interrupting your subscription may terminate promotional pricing programs unless expressly stated otherwise.
5.8 Compliance With Applicable Laws
MyFamilyStory complies with all applicable subscription, billing, and auto-renewal laws. We strive to ensure that all subscription terms are presented clearly, renewal reminders are timely, and cancellation mechanisms are simple and accessible.
6. Promotional Programs
MyFamilyStory may offer promotional programs from time to time. These programs are optional, limited in duration, and subject to the terms described in this Section. Promotional programs may provide discounted pricing, additional credits, extended trial periods, or other benefits. All promotional terms are displayed clearly at the time of enrollment and are incorporated into these Terms by reference.
Promotions do not alter the underlying subscription tier structure or Family Plan member limits. All credit-related entitlements associated with promotions are governed by the Credits Policy.
Participation in any promotional program is voluntary. If you do not wish to participate, you may subscribe at the standard price displayed during checkout.
6.1 Founding Member PriceLock Guarantee
The Founding Member PriceLock Guarantee (PriceLock) is a limited-time promotional program available only during the initial launch period of MyFamilyStory. This program is designed to honor early supporters who believe in the mission of preserving family heritage and choose to begin their journey with us from the start.
Eligibility - You are eligible for Founding Member status if:
- you subscribe during the promotional launch window, and
- you maintain an active, uninterrupted subscription.
Eligibility is determined at the time of purchase. Once the promotional window closes, new subscriptions cannot obtain Founding Member status.
PriceLock Guarantee - Founding Members receive a PriceLock Guarantee, meaning:
- your subscription price will not increase for as long as your subscription remains active and uninterrupted, subject to the adjustments described below;
- you will continue to pay the same monthly or annual rate you received at enrollment unless you change your tier or billing cycle;
- the PriceLock applies only to the subscription tier and billing cycle you are currently subscribed to.
Changes to your Subscription Tier
- You may upgrade your subscription tier at any time (e.g., move from Family Starter to Family Builder). The upgrade will be billed at the then-current public price for the higher tier. That new price becomes your new PriceLock for the life of your active subscription.
- You may downgrade at the then-current public price for the lower tier (e.g., move from Family Builder to Family Starter). However downgrading permanently terminates your PriceLock. After the downgrade, you will no longer be eligible for Founding Member PriceLock benefits.
Changes to your Billing Cycle
- You may switch between monthly and annual billing cycle at any time.
- That new price becomes your new PriceLock for the life of your active subscription or until you make another change.
- Moving from annual to monthly will naturally remove any annual-plan discount (e.g., the inherent 17% savings associated with annual billing).
Loss of Founding Member Status - You will permanently lose Founding Member status if: a) you cancel your subscription, b) your subscription lapses due to non-payment or through other cancellation, or c) you downgrade to a lower subscription tier (as described above). Once lost, Founding Member status cannot be reinstated.
Credits and Entitlements - All credit-related entitlements for Founding Members, including credits, rollover rules, expiration windows, and consumption behavior, are governed by the Credits Policy. The PriceLock Guarantee applies only to subscription pricing and credit allocations. It does not apply to recipe or feature pricing, Top Up Credit Packs, or any usage-based charges or feature entitlements, which may evolve over time.
6.2 General Promotions
MyFamilyStory may offer additional promotional programs from time to time, including but not limited to: a) extended trials, b) discounted subscription periods, c) bonus credits, d) referral incentives, e) partner or community promotions, and f) limited-time offers for specific user groups. Each promotion will include its own terms, duration, eligibility criteria, and benefits. Promotional terms will be presented clearly at the time of enrollment and will govern your participation.
Promotions:
- do not alter the underlying subscription tier structure,
- do not modify Family Plan member limits,
- do not guarantee future pricing unless expressly stated in the promotion,
- may be changed or discontinued at any time.
Unless expressly stated, promotional pricing does not continue after the promotional period ends.
6.3 Interaction With Auto-Renewal
If a promotion converts into a paid subscription:
- renewal pricing will be displayed clearly at checkout,
- renewal reminders will be sent in compliance with applicable law,
- you may cancel at any time before renewal to avoid charges.
Promotional periods do not override your right to cancel.
6.4 Interaction With Credits Policy
All promotions that include Credits are governed by the Credits Policy with respect to the Credits. The Credits Policy describes: a) how promotional credits are issued, b) how they expire, c) how they are consumed, d) how they interact with subscription credits, and e) how they behave upon cancellation or lapse. Promotional credits may have different expiration windows or consumption rules than subscription credits, as described in the Credits Policy.
7. Credits
Credits are the unit of consumption used across the MyFamilyStory Platform for certain features, including restoration tools, AI recipes, Family Talk minutes, and other credit-based services. Credits are allocated according to your subscription tier and may also be provided through promotional programs or optional top-ups.
Credits do not represent cash, have no cash value, and cannot be redeemed for money. Credits are a functional component of the Platform and exist solely to enable access to credit-based features.
All credit-related rules, including without limitation allocations, rollover, expiration, consumption order, refunds, grace periods, expiration, cancellation or forfeiture, promotional behavior, and history storage, are governed exclusively by the Credits Policy, which is incorporated by reference into these Terms. The Credits Policy describes how credits function within each subscription tier and how they interact with promotional programs, Family Plans, and Branch collaboration.
8. Content Storage Duration
MyFamilyStory stores user content that may be uploaded to or generated on the Platform, including stories, history entries, photos, videos, and related media (“User Content”), for varying durations depending on your account type. MyFamilyStory does not guarantee storage for any user who does not maintain an active paid subscription, except as expressly stated below.
8.1 Subscribers & Guest Accounts
Subscribers receive full storage rights for the duration of their active subscription. All User Content created or uploaded during an active subscription is stored for the life of the subscription.
Guest Accounts
When a paid subscription ends in good standing, the account converts to a Guest Account, which provides:
- read-only access to previously created or uploaded content;
- no ability to upload new content, create new stories, or use paid features;
- continued storage of User Content is subject to the inactivity rules below.
You must maintain a current, valid email address associated with your account. If your email becomes invalid or undeliverable, MyFamilyStory may be unable to provide notices required under these Terms.
Inactivity
If a Guest Account remains inactive for twelve (12) consecutive months, MyFamilyStory may initiate deletion of the account and all associated content.
Before deletion:
- MyFamilyStory will send a notice to the email address on file;
- You will be given a reasonable opportunity to keep your archive active;
- If you do not respond or log in within the stated timeframe, your account and all stored content may be permanently deleted.
Exclusions
Guest Account status is provided only when a subscription ends in good standing. You will not receive Guest Account access if your account is terminated due to:
- violation of these Terms,
- misuse of the service,
- unlawful activity, or
- actions that pose risk to MyFamilyStory or other users.
In such cases, your account will be closed and your content may be deleted in accordance with the Privacy Policy and applicable law.
If your subscription ends due to non-payment, MyFamilyStory may convert your account to a Guest Account at its discretion. MyFamilyStory reserves the right to deny Guest Account status in cases involving fraud, abuse, or other violations.
8.2 Visiting Relatives (Gifted Credits or Top-Up Purchases, No Subscription)
Visiting Relatives are users who participate in a family member’s archive using gifted credits or purchased Top-Up Credit Packs, but who do not hold a paid subscription.
- User Content uploaded or created within a Subscriber’s library of content, or which contributes to the Subscriber’s Atlas or Family Tree, follows the Subscriber’s storage rules, not the Visiting Relative’s.
- User Content created or uploaded by a Visiting Relative that is stored only in the Visiting Relative’s personal library will be retained for ninety (90) days.
- If the Visiting Relative does not upgrade to a paid subscription within such ninety (90) day period, the Visiting Relative’s User Content may at MyFamilyStory’s discretion be permanently deleted.
- Before deletion, MyFamilyStory will send a notice to the email address on file and provide a reasonable opportunity to upgrade or export content.
This limited retention reflects the temporary nature of Visiting Relative access.
8.3 Trial Users (7-Day Paid Trial)
Trial Users receive temporary access to paid features for evaluation purposes.
- User Content created or uploaded during a trial is stored for ninety (90) days from the end of the trial period.
- If you do not upgrade to a paid subscription within ninety (90) days of the end of your trial period, your User Content may at MyFamilyStory’s discretion be permanently deleted.
- Upgrading to a paid subscription within such time period converts your account to Subscriber status, and your content becomes subject to Subscriber storage rules.
- Before deletion, MyFamilyStory will send a notice to the email address on file and provide a reasonable opportunity to upgrade or export content.
Due to the short-term paid relationship, Trial Users are limited to a defined retention window.
8.4 Non-Subscribers (Free Users)
Non-Subscribers are users who interact with free features but do not hold a paid subscription, trial, or Visiting Relative status.
- Anytime following ninety (90) days after creating your account, MyFamilyStory may store or delete Non-Subscriber User Content at its discretion.
- Anytime after such ninety (90) day period, User Content may be deleted at any time and without further notice.
- Before deletion, MyFamilyStory will send a notice to the email address on file and provide a reasonable opportunity to upgrade or export content.
- Non-Subscribers should not rely on MyFamilyStory for long-term storage, as free access is designed for short-term exploration of the service.
8.5 User Request
For all user categories, MyFamilyStory will delete your User Content upon your request within the time required by applicable law. We will verify your identity before processing the request and will complete deletion in accordance with our Privacy Policy and all legal obligations.
9. Responsible AI Use
You agree to use AI features ethically and in accordance with this Responsible AI You agree not to use any revived likeness, synthetic voice, or AI-generated persona of any individual (living or deceased) for deceptive, defamatory, or harmful purposes.
